1. Introduction

Welcome to VersityFinds. By registering an account and utilizing the services offered on our platform as a general user (customer), you expressly acknowledge that you have read, understood, and agreed to be legally bound by the terms of this General User Agreement. This Agreement serves to define your rights, obligations, and limitations as a user who engages with the platform for purposes such as browsing products, placing orders, and participating in platform-related activities. It is an essential supplement to the broader Terms and Conditions governing the use of VersityFinds and must be read in conjunction with our Privacy Policy and any additional policies referenced herein. Your continued use of the platform signifies your acceptance of these terms and your commitment to comply with all applicable legal and operational standards established by VersityFinds.

2. User Experience

As a registered general user of the VersityFinds platform, you are granted access to a range of features designed to enhance your shopping experience. These include the ability to:

• Registration Requirement: You must complete the full registration process, including email and phone verification, before you are permitted to place orders or leave reviews.
• Accuracy of Information: Any misleading or false information provided during registration or while updating your profile may result in account suspension or restriction.
• Access Limitations: Use of the platform features is subject to compliance with these terms and all applicable policies. Any misuse of available functions (e.g., posting fraudulent reviews or repeatedly reporting legitimate sellers without cause) is prohibited and may result in disciplinary action, including removal of privileges or termination of account.

3. Order Payments & Cancellations

VersityFinds facilitates secure transactions between customers and registered sellers. As a customer, you acknowledge and agree to the following terms regarding order payments and cancellations:

• Payment Authorization: All orders must be fully paid at the time of placement. Payments are processed prior to seller acceptance to ensure a seamless checkout and commitment to the order.
• Seller Acceptance Policy: Orders remain in a pending state until confirmed by the respective seller. VersityFinds provides order tracking status updates to inform you of the current state of your order.
• Cancellations Prior to Seller Acceptance: If you choose to cancel an order before it has been accepted by the seller, a processing or reversal fee may apply. This fee covers the administrative and financial costs incurred during payment handling.
• No Cancellations Post Acceptance: Once the seller accepts the order, cancellations are strictly disallowed due to operational and logistical constraints. This policy helps prevent disruption to seller workflow and ensures consistent delivery timelines.
• Refunds and Returns: Any request for refunds or returns is governed by a separate Refund and Return Agreement, which outlines detailed procedures, eligibility, timelines, and responsibilities of both parties. By placing an order, you agree to be bound by the terms of that agreement.
• Chargeback Misuse: Unwarranted or malicious chargebacks filed outside the platform's support procedures are considered a violation of this agreement and may result in account suspension or legal action.

4. Dispute Resolution

VersityFinds is committed to maintaining a fair and transparent environment for all users. In the event of a disagreement or dispute arising between a customer and a seller regarding an order, product, or service, the following procedures shall apply:

• Internal Resolution Process: All disputes must first be reported and addressed through the VersityFinds internal support system. Customers are required to submit a formal complaint via the platform's support interface, providing relevant order details and supporting documentation to initiate the resolution process.
• Timeframe for Resolution: Both parties must make reasonable efforts to cooperate with the VersityFinds support team to resolve the matter in good faith. Resolution will typically be attempted within 7 to 14 business days, depending on the complexity of the issue.
• Escalation Clause: If a satisfactory resolution cannot be achieved through internal procedures, the dispute may be escalated in accordance with the applicable laws of the Republic of South Africa. VersityFinds will facilitate necessary documentation and communication records for any legal proceedings, but will not be held liable for the final outcomes decided by a third party or court of law.
• Binding Platform Procedures: Customers and sellers agree to abide by all platform-mediated resolutions unless otherwise instructed by a legal authority. Ignoring internal resolution outcomes without proper cause may result in account limitations, suspension, or permanent removal.

5. Behaviour & Fairness

At VersityFinds, we strive to maintain a secure, respectful, and trustworthy environment for all users, sellers, and partners. All registered users are expected to conduct themselves with integrity and adhere strictly to the following behavioral standards:

Prohibited Conduct

The following activities are strictly forbidden and may result in immediate suspension or termination of the user's account:

• Placing fraudulent or repetitive orders with no intention to purchase, including any form of spam or manipulation of listings.
• Harassment or abuse directed at sellers, fellow customers, or platform support representatives, whether through reviews, reports, or platform interactions.
• Unwarranted or abusive chargebacks, especially those intended to exploit the platform's payment and refund systems.
• Any deliberate attempt to disrupt or manipulate the normal operations of VersityFinds, including but not limited to system tampering, impersonation, or coordinated disruption campaigns.

Account Identity and Usage

• Each user is permitted to create only one primary account, associated with a verified email address and a single primary phone number.
• Backup contact information (such as additional email addresses and secondary phone numbers) may be added for account recovery purposes only, and must be valid and owned by the user.
• Users found operating multiple accounts under different identities or submitting false identity information may face permanent bans.
• Your primary email will be used to verify your identity during account upgrades, including business or driver registrations, and for any sensitive account changes.

VersityFinds reserves the right to investigate and take appropriate action—including warnings, suspensions, or permanent account deactivation—for any behavior that undermines platform integrity or fairness.

6. Data Communication

By registering and using the VersityFinds platform, you explicitly consent to receive electronic communications related to your activity on the platform. This includes but is not limited to transactional notifications, service updates, account-related alerts, and marketing communications.

Transactional & System Communications

• You agree to receive automated system-generated notifications via email related to order updates, payment confirmations, account activity, password resets, and platform-related alerts.
• These communications are essential for proper service delivery and cannot be opted out of unless you deactivate your account.

Marketing & Promotional Messages

• You may receive periodic marketing emails that include promotions, new features, service announcements, or personalized offers based on your usage behavior.
• Users will have the option to unsubscribe from non-essential marketing communications through clearly marked links within the emails.

User-to-Seller Communication

• As of now, direct messaging or communication between users and sellers through the platform is not supported.
• All updates regarding an order or seller status are communicated solely through the order tracking system and notification infrastructure managed by VersityFinds.
• Any attempt to bypass this limitation using fraudulent means may result in account suspension.

VersityFinds may modify its communication policies as the platform evolves. Any such changes will be clearly communicated through system notifications or policy updates.

7. Privacy and Data Use

VersityFinds is committed to protecting your privacy and ensuring the responsible use of your personal information. This section outlines how your data is collected, processed, and protected when using the platform as a general user (customer).

Data Collection

We collect and process various types of personal information to enable the functionality and reliability of the platform. This includes, but is not limited to:

• Personal identifiers (e.g., full name, email address, phone number)
• Delivery information (e.g., physical address, preferred delivery instructions)
• Account activity (e.g., order history, browsing behavior)
• Device and usage information (e.g., IP address, browser type)

This data is used primarily to deliver services, ensure a secure and personalized user experience, and improve the platform through analytics.

Purpose and Use

Your personal data is used for the following purposes:

• To manage and fulfill your orders
• To personalize your shopping experience
• To maintain account security and detect suspicious activities
• To send transactional and marketing communications (with consent)
• To perform platform analytics and improve service delivery

Data Sharing and Legal Disclosure

VersityFinds does not sell or share your personal data with third parties for commercial purposes. However, we may disclose your information:

• To protect the rights, property, or safety of VersityFinds, its users, or the public

8. Account Security & Responsibility

As a registered user of VersityFinds, you are solely responsible for maintaining the confidentiality and integrity of your account credentials. This includes your username, password, and any associated verification methods such as linked phone numbers or recovery emails.

User Responsibility

You agree to take all reasonable measures to protect your login details from unauthorized access. Activities that occur under your account are presumed to be authorized by you, and you will be held accountable for all actions taken through your account, including but not limited to:

• Placing orders
• Submitting reviews or reports
• Updating personal or delivery information
• Engaging with system-generated notifications or offers

It is your duty to ensure that your account is not used in any manner that violates this Agreement or applicable laws.

Unauthorized Access

If you suspect any unauthorized access to your account or detect any suspicious activity (e.g., unexpected changes to personal information or order history), you must immediately notify the VersityFinds support team. We reserve the right to suspend or disable access to your account during the investigation to protect both your data and the platform's integrity.

VersityFinds is not liable for any losses or damages resulting from your failure to maintain the confidentiality of your login credentials or from delayed reporting of unauthorized use.

Best Practices

We strongly recommend the following security measures:

• Use a strong, unique password for your account.
• Enable two-factor authentication (if available).
• Log out after accessing your account on shared or public devices.
• Regularly update your credentials and review your account activity.

9. Platform Availability & Limitations

At VersityFinds, we are committed to providing a reliable and efficient platform for our users. However, due to the complex nature of digital infrastructure and third-party dependencies, we cannot guarantee that the platform will operate continuously without interruption or error.

Scheduled and Unscheduled Downtime

We may, from time to time, perform routine maintenance or implement system upgrades, during which the platform may be temporarily unavailable. Where feasible, we will provide advance notice of such downtime via system notifications or email. However, we reserve the right to conduct unscheduled maintenance at any time if deemed necessary for security or performance reasons.

Service Interruptions and Access Issues

While we strive for high uptime and optimal performance, users acknowledge that access to the platform may occasionally be disrupted due to:

• Technical failures beyond our control (e.g., internet service interruptions, server malfunctions)
• Cybersecurity threats or incidents
• Force majeure events such as natural disasters or regulatory actions

VersityFinds shall not be held liable for any loss of data, revenue, or business opportunity resulting from such interruptions. Users are encouraged to retain backup copies of any critical information uploaded or submitted through the platform.

Limitation of Warranties

The platform and all related services are provided "as is" and "as available" without warranties of any kind, either express or implied. This includes but is not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We make no guarantees regarding:

• Uninterrupted or secure access to the platform
• Timeliness, accuracy, or completeness of the platform's content
• The performance or behavior of sellers or third-party service providers

10. Termination of Access

VersityFinds reserves the right to manage access to its platform in order to maintain a safe, secure, and fair environment for all users. By agreeing to these terms, you acknowledge and accept that your access to the platform is subject to compliance with all applicable policies, guidelines, and laws.

Grounds for Termination or Suspension

Your account access may be temporarily suspended, restricted, or permanently terminated at our sole discretion, including but not limited to the following reasons:

• Violation of any provision in this User Agreement, the broader Terms and Conditions, or related policies
• Engaging in fraudulent, abusive, or deceptive behavior
• Attempting to compromise the integrity, performance, or security of the platform
• Submitting false or misleading information during registration or use of services
• Repeated customer complaints or chargebacks
• Legal obligations, such as court orders or regulatory enforcement

We may implement restrictions or suspensions immediately, without prior notice, where necessary to prevent harm to other users, our platform, or our partners.

Finality of Termination

If your account is terminated, either temporarily or permanently:

• You will no longer have access to the platform or any associated services.
• VersityFinds is under no obligation to reinstate your account or grant you future access.
• Any data associated with your account may be retained or deleted in accordance with our data retention and privacy policies.

Appeals and Reinstatement

While reinstatement is not guaranteed, users may submit a formal appeal explaining the circumstances that led to the suspension or termination. Appeals will be reviewed on a case-by-case basis, and VersityFinds retains full discretion over final decisions.

11. Modifications

VersityFinds reserves the right to revise, amend, or modify this General User Agreement at any time to reflect changes in legal requirements, business operations, user feedback, or platform features.

Notice of Changes

Significant updates to this Agreement will be communicated to users through appropriate channels, which may include system notifications, email alerts, or prominent announcements on our platform. It is your responsibility to review these communications and stay informed of any updates that may affect your rights or obligations.

Effective Date of Changes

Unless otherwise specified, modifications become effective immediately upon being published on the platform. Minor or administrative updates may not always be accompanied by a separate notification, but all changes will be reflected in the "Last Updated" date at the beginning of this Agreement.

Acceptance of Updated Terms

By continuing to access or use VersityFinds after any modifications are made, you are deemed to have accepted the revised terms in full. If you do not agree with the updated provisions, you must discontinue use of the platform and close your account.

We encourage all users to regularly review this Agreement to ensure continued understanding of their rights and responsibilities.

12. Eligibility & User Definition

In order to use the VersityFinds platform as a general user (customer), you must meet specific eligibility criteria and understand the nature of your user classification.

Age and Legal Capacity

By registering and using the VersityFinds platform, you affirm that you are at least 18 years of age or possess the legal capacity under your jurisdiction to enter into binding contracts. Users under the age of 18 may only access the platform with the explicit consent and supervision of a parent or legal guardian, who shall be fully responsible for the minor's use of the platform.

General User Classification

A "General User" refers to any individual who registers on the platform for the purpose of browsing listings, making purchases, interacting with sellers through platform features, or receiving goods or services—excluding those registering as business entities (sellers) or as service partners (drivers). General users are automatically placed in the customer group upon successful registration, and may later opt to upgrade their status by initiating separate registrations.
